Our Websites. When you use our Websites, we collect and analyze information such as your IP address, browser types, browser language, operating system, the state or country from which you accessed the Services, software and hardware attributes (including device IDs) referring and exit pages and URLs, platform type, the number of clicks, files you download, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the terms you use in searches on our sites, the date and time you used the Services, error logs, and other similar information.

Our Apps. When you use our Apps, we automatically receive certain information about the mobile phone, tablet, or computer used to access the Apps, including a mobile device identifier, IP address, operating system, version, Internet service provider, browser type, domain name and other similar information, whether and when you update the Apps, date and time of use, and how you use the Apps, including time spent in different portions of the Apps.

Location Information. When you use the Services, we and our service providers may automatically collect general location information (e.g., IP address, city/state and or postal code associated with an IP address) from your computer or mobile device. This information allows us to enable access to content that varies based on a user’s general location (e.g., to provide you with accurate sales tax information and to deliver content customized to your location).

We will ask your permission before collecting your precise GPS location information. In such instances, we will use your precise geo-location information to provide customized services, content, promotional offers and other information that may be of interest to you. If you no longer wish for us and our service providers to collect and use GPS location information, you may disable the location features on your device. Our Use of Cookies and Similar Online Tools. To collect the information discussed in this Section, we and our service providers use web server logs, cookies, tags, SDKs, tracking pixels, and other similar tracking technologies. We use these technologies to offer you a more tailored experience.

Online Analytics And Advertising

1. Online Analytics

We may use third-party web analytics services (such as those of Google Analytics including Google Signals, Google User-ID, and other Google Analytics features) on our Services to collect and analyze usage information through cookies and similar tools; engage in auditing, research, or reporting; assist with fraud prevention; try to locate the same unique users across multiple browsers or devices to better tailor services and features; and provide certain features to you. 2. Online Advertising

The Services may integrate third-party advertising technologies (e.g., ad networks and ad servers such as Facebook, Google Ad Words, and others) that use cookies and other technologies to deliver relevant content and advertising for iLiveActive products on the Services, as well as on other websites you visit and other applications you use. The ads may be based on various factors such as the content of the page you are visiting, information you enter such as your searches, demographic data, and other information we collect from you. These ads may be based on your current activity or your activity over time and across other websites and online services.

We sometimes provide our customer information (such as email addresses) to service providers, who may “match” this information in de-identified form to cookies (or mobile ad identifiers) and other proprietary IDs, in order to provide you with more relevant ads when you visit other websites and mobile applications.

We neither have access to, nor does this Privacy Policy govern, the use of cookies or other tracking technologies that may be placed on your device you use to access the Services by non-affiliated third party advertising network services. If you are interested in more information about tailored browser advertising and how you can generally control cookies from being put on your computer to deliver tailored advertising, you may visit the Network Advertising Initiative’s Consumer Opt-Out link, the Digital Advertising Alliance’s Consumer Opt-Out link, or Your Online Choices to opt-out of receiving tailored advertising from companies that participate in those programs. Please note that if you exercise the opt out choices above, you will still see advertising when you use the Services, but it will not be tailored to you based on your online behavior over time.

3. Mobile Advertising

When using mobile applications from us or others, you may also receive tailored in-application advertisements. We may use third-party service providers to deliver advertisements on mobile applications or for mobile application analytics. Each operating system, iOS for Apple phones, Android for Android devices, and Windows for Microsoft devices provides its own instructions on how to prevent the delivery of tailored in-application advertisements. We do not control how the applicable platform operator allows you to control receiving personalized in-application advertisements; thus, you should contact the platform provider for further details on opting out of tailored in-application advertisements. You may review the support materials and/or the device settings for the respective operating systems to opt-out of tailored in-app advertisements.

How We Share Your Information

  • Affiliates and Subsidiaries. We may share information we collect within any iLiveActive member or group (i.e., our subsidiaries and affiliates, including our ultimate holding company and its subsidiaries) to deliver products and services to you, ensure a consistent level of service across our products and services, and enhance our products, services, and your customer experience.
  • Health Care Providers and Services. We share your information with health care providers:
    (i) to schedule and fulfill appointments and provide health care services as part of the Services,
    (ii) to whom you send messages through our Services, and
    (iii) for other treatment, payment or health care operations purposes, including pharmacy services, upon your request.
  • Service Providers. We provide access to or share your information with select third parties who use the information to perform services on our behalf. They provide a variety of services to us, including billing, sales, marketing, advertising, analytics, research, customer service, shipping and fulfillment, data storage, IT and security, fraud prevention, payment processing, and auditing and legal services. These entities may also include health care organizations, pharmacies, and other third parties we use to support our business or in connection with the administration and support of the Services.
  • Protection of iLiveActive and Others. By using the Services, you acknowledge and agree that we may access, retain and disclose the information we collect and maintain about you if required to do so by law or in a good faith belief that such access, retention or disclosure is reasonably necessary to:
    (a) comply with legal process (e.g. a subpoena or court order);
    (b) enforce our Terms of Use, this Privacy Policy, or other contracts with you, including investigation of potential violations thereof;

  • Public Forums. Certain features of our Services make it possible for you to share comments publicly with other users. Any information that you submit through such features is not confidential, and we may use it for any purpose (including in testimonials or other marketing materials). For example, if you submit a product review on one of our sites, we may display your review (along with the name provided, if any) on other iLiveActive websites and on third-party websites. 1. Permitted Uses and Disclosures of Your PPHI

iLiveActive USA Inc. may use and disclose your PPHI for the following purposes.

  • Treatment: iLiveActive USA Inc. may use and disclose your PPHI to healthcare professionals or other third parties to provide, coordinate and manage the delivery of healthcare. For example, your provider may disclose PPHI about you to your doctor in order to coordinate the prescribing and delivery of your drugs. iLiveActive USA Inc. also may provide you with treatment reminders and information about potential side effects, drug interactions and other treatment-related issues involving your medicine.
  • Payment: iLiveActive USA Inc. may use and disclose PPHI about you to receive payment for our services, manage your account, fulfill our responsibilities under your benefit plan, and process your claims for drugs you have received. For example, if applicable, iLiveActive USA Inc. may give PPHI to a third party payor so iLiveActive USA Inc. may submit claims to your health plan, employer or other third party for payment.
  • Healthcare Operations: iLiveActive USA Inc. may use and disclose your PPHI to carry on our own business planning and administrative operations. iLiveActive USA Inc. needs to do this so iLiveActive USA Inc. can provide you with high-quality services. For example, iLiveActive USA Inc. may use and disclose PPHI about you to assess the use or effectiveness of certain drugs, develop and monitor medical protocols, and to provide information regarding helpful health-management services.
  • Information That May Be of Interest to You: iLiveActive USA Inc. may use or disclose your PPHI to contact you about treatment options or alternatives that may be of interest to you. For example, iLiveActive USA Inc. may call you to remind you of expired prescriptions, the availability of alternative drugs, or to inform you of other products that may benefit your health.
  • Individuals Involved in Your Care or Payment for Your Care: iLiveActive USA Inc. may disclose PPHI about you to someone who assists in or pays for your care. Unless you write to us and specifically tell us not to, iLiveActive USA Inc. may disclose your PPHI to someone who has your permission to act on your behalf. iLiveActive USA Inc. will require this person to provide adequate proof that he or she has your permission.
  • Parents or Legal Guardians: If you are a minor or under a legal guardianship, iLiveActive USA Inc. may release your PPHI to your parents or legal guardians when iLiveActive USA Inc. is permitted or required to do so under federal and applicable state law.
  • Business Associates: iLiveActive USA Inc. arranges to provide some services through contracts with business associates so that they may help us operate more efficiently. iLiveActive USA Inc. may disclose your PPHI to business associates acting on our behalf. If any PPHI is disclosed, iLiveActive USA Inc. will protect your information from unauthorized use and disclosure using confidentiality agreements. Our business associates may, in turn, use vendors to assist them in providing services to us. If so, the business associates must enter into a confidentiality agreement with the vendor, which protects your information from unauthorized use and disclosure.
  • Research: Under certain circumstances, iLiveActive USA Inc. may use and disclose PPHI about you for research purposes. Before iLiveActive USA Inc. uses or discloses PPHI about you, iLiveActive USA Inc. will either remove information that personally identifies you, obtain your written authorization or gain approval through a special approval process designed to protect the privacy of your PPHI. In some circumstances, iLiveActive USA Inc. may use your PPHI to generate aggregate data (summarized data that does not identify you) to study outcomes, costs and provider profiles, and to suggest benefit designs for your employer or health plan. These studies generate aggregate data that iLiveActive USA Inc. may sell or disclose to other companies or organizations. Aggregate data does not personally identify you.
  • Abuse, Neglect or Domestic Violence: iLiveActive USA Inc. may disclose your PPHI to a social service, protective agency or other government authority if iLiveActive USA Inc. believes you are a victim of abuse, neglect or domestic violence. iLiveActive USA Inc. will inform you of our disclosure unless informing you would place you at risk of serious harm.
  • Public Health: iLiveActive USA Inc. may disclose your PPHI for public health activities and purposes, such as reporting adverse events, post-marketing surveillance in connection with FDA-regulated entities' legal obligations (for example, pharmaceutical manufacturer reporting or connections with an FDA-mandated Risk Evaluation and Mitigation Strategies (REMS) program) and product recalls. iLiveActive USA Inc. may also disclose your PPHI to a person or company that is regulated by the U.S. Food and Drug Administration, such as a pharmaceutical manufacturer, for the purpose of:
    (i) reporting or tracking product defects or problems;
    (ii) repairing, replacing, or recalling defective or dangerous products; or
    (iii) monitoring the performance of a product after it has been approved for use by the general public. iLiveActive USA Inc. may receive payment from a third party for making disclosures for public health activities and purposes.
  • Health Oversight: iLiveActive USA Inc. may disclose PPHI to a health oversight agency performing activities authorized by law, such as investigations and audits. These agencies include governmental agencies that oversee the healthcare system, government benefit programs, and organizations subject to government regulation and civil rights laws.
  • Creation of De-Identified Health Information: iLiveActive USA Inc. may use your PPHI to create data that cannot be linked to you by removing certain elements from your PPHI, such as your name, address, telephone number, and member identification number. iLiveActive USA Inc. may use this de-identified information to conduct certain business activities; for example, to create summary reports and to analyze and monitor industry trends.
  • To Avert Serious Threat to Health or Safety: iLiveActive USA Inc. may disclose your PPHI to prevent or lessen an imminent threat to the health or safety of another person or the public. Such disclosure will only be made to someone in a position to prevent or lessen the threat.
  • Judicial Proceedings: iLiveActive USA Inc. may disclose your PPHI in the course of any judicial proceeding in response to a court order, subpoena or other lawful process, but only after iLiveActive USA Inc. has been assured that efforts have been made to notify you of the request.
  • Law Enforcement: iLiveActive USA Inc. may disclose your PPHI, as required by law, in response to a subpoena, warrant, summons, or, in some circumstances, to report a crime.
  • Coroners and Medical Examiners: iLiveActive USA Inc. may disclose your PPHI to a coroner or a medical examiner for the purpose of determining cause of death or other duties authorized by law.
  • Organ, Eye and Tissue Donation: iLiveActive USA Inc. may disclose your PPHI to organizations involved in organ transplantation to facilitate donation and transplantation.
  • Workers' Compensation: iLiveActive USA Inc. may disclose your PPHI to comply with workers' compensation laws and other similar programs.
  • Specialized Government Functions, Military and Veterans: iLiveActive USA Inc. may disclose your PPHI to authorized federal officials to perform intelligence, counterintelligence, medical suitability determinations, Presidential protection activities, and other national security activities authorized by law. If you are a member of the U.S. armed forces or of a foreign military, iLiveActive USA Inc. may disclose your PPHI as required by military command authorities or law. If you are an inmate in a correctional institution or under the custody of a law enforcement official, iLiveActive USA Inc. may disclose your PPHI to those parties if disclosure is necessary for:
    (i) the provision of your healthcare;
    (ii) maintaining the health or safety of yourself or other inmates; or
    (iii) ensuring the safety and security of the correctional institution or its agents.
  • As Otherwise Required By Law: iLiveActive USA Inc. will disclose PPHI about you when required to do so by law. If federal, state or local law within your jurisdiction offers you additional protections against improper use or disclosure of PPHI, iLiveActive USA Inc. will follow such laws to the extent they apply.
  • Other Uses and Disclosures: Most uses and disclosures of psychotherapy notes (where appropriate), uses and disclosures for marketing purposes and disclosures that constitute a sale of PPHI require an authorization. Any of these activities and any other uses and disclosures of your PPHI not listed in this Notice will be made only with your authorization unless iLiveActive USA Inc. are permitted by applicable law to make such other use and disclosure in which case iLiveActive USA Inc. shall comply with applicable law. You may revoke your authorization, in writing, at any time unless iLiveActive USA Inc. has taken action in reliance upon it. Written revocation of authorization must be sent to the address listed below.

2. Your Rights With Respect to Your PPHI

You have the following rights regarding PPHI iLiveActive USA Inc. maintain about you:

  • Right to Inspect and Copy: Subject to some restrictions, you may inspect and copy PPHI that may be used to make decisions about you. If iLiveActive USA Inc. maintains an electronic health record containing your PPHI, you have the right to request that iLiveActive USA Inc. send a copy of your PPHI in an electronic format to you or to a third party that you identify.
  • Right to Amend: If you believe PPHI about you is incorrect or incomplete, you may ask us to amend the information. You must provide a reason supporting your request to amend.
  • Right to an Accounting of Disclosures: You have the right to request an accounting of disclosures of your PPHI. This accounting identifies the disclosures iLiveActive USA Inc. has made of your PPHI other than for treatment, payment or healthcare operations. The provision of an accounting of disclosures is subject to certain restrictions.
  • Right to Request Restrictions: You have the right to request a restriction or limitation on the PPHI iLiveActive USA Inc. use and disclose about you for treatment, payment or healthcare operations. You may also request your PPHI not be disclosed to family members or friends who may be involved in your care or paying for your care. Your request must: (i) be in writing; (ii) state the restrictions you are requesting; and (iii) state to whom the restriction applies. iLiveActive USA Inc. is not required to agree to your request. If iLiveActive USA Inc. does agree, iLiveActive USA Inc. will comply with your request unless the restricted information is needed to provide you with emergency treatment.
  • Confidential Communications: You may ask that iLiveActive USA Inc. communicate with you in an alternate way or at an alternate location to protect the confidentiality of your PPHI. Your request must state an alternate method or location you would like us to use to communicate your PPHI to you.
  • Right to be Notified: You have the right to be notified following a breach of unsecured PPHI if your PPHI is affected.
  • Right to a Paper Copy of This Notice: You have the right to request a paper copy of this Notice at any time. Even if iLiveActive USA Inc. has agreed to provide this Notice electronically, you are still entitled to a paper copy. You may obtain a copy of this Notice from our website at www.iliveactive.com
  • Right to File a Complaint: If you believe iLiveActive USA Inc. has violated your privacy rights, you may file a written complaint to Express Scripts at the address listed below. You may also file a complaint with the Secretary of the U.S. Department of Health and Human Services. You will not face retaliation for filing a complaint.
